Material Safety Data Sheet (MSDS) submission grace period expires

As a result of the amendment to the Occupational Safety and Health Act, the Material Safety Data Sheet (MSDS) submission and non-disclosure approval system has been in effect since January 21, 2016.  The grace period for submitting MSDSs expired on January 16, 2025, for substances subject to MSDSs that were manufactured or imported before the effective date (January 21, 2016) with an annual manufacturing or import volume of 1-10 tons.  By January 16, 2026, the grace period for chemicals (products) with a volume of less than 1 ton will end, so all products that have been granted the exemption will need to be submitted this year.

1. more than 1,000 t/y: January 16, 2022 

2. 100-1,000t/y: January 16, 2023 

3. 10-100 t/y: January 16, 2024 

4. 1-10 t/y: January 16, 2025 

5. less than 1 t/y: January 16, 2026
