According to Article 54-2 of the K-BPR, in case of importing a biocidal active substance or
a biocidal product from abroad,
an overseas manufacturers/producers may appoint a person who
meets the requirements prescribed by the Ordinance of the Ministry of Environment to
carry
out legal work on behalf of the person who imports or intends to import them.
Safety Assessment Solution Co., Ltd. provides overseas manufacturerㆍproducers with the
following services regarding the K-BPR.
1. Notification of existing biocidal active substance to obtain an approval grace period
2. Notification and approval of new biocidal active substance
3. Application for approval of substance equivalence
4. Submission of application plans for biocidal active substance approval, etc.
5. Product approval, and approval/notification of changes
6. Application for special approval for biocidal products
7. Application for approval of product similarity
8. Reporting and taking measures for newly identified risk, etc.
9. Approval/notification of changes after approval
10. Other affairs prescribed by presidential decree, such as provision of information
Imprisonment for not more than 7 years or a fine not exceeding 70 million won
1. Any person who manufactures or imports an active substance without approval or under the approval obtained by fraud or other improper means
2. Any person who manufactures or imports a biocidal active substance that approval or acceptance for substance equivalence of a biocidal active substance was canceled or that is ordered to suspend manufacture or import
3. Any person who manufactures or imports a biocidal product after having failed to obtain biocidal product approval or having obtained such approval by fraud or other improper means
4. Any person who manufactures or imports a biocidal product that approval or acceptance for product equivalence of a biocidal product was canceled, or that is ordered to suspend manufacture or import
5. Any person who manufactures or imports a biocidal active substance different from details of the approved biocidal active substance and the approved biocidal product
Imprisonment for not more than 5 years or a fine not exceeding 50 million won
1. Any person who manufactures or imports a biocidal active substance or a biocidal product after having failed to obtain approval of changes or having obtained approval of changes by fraud or other improper means.
2. Any person who manufactures or imports a biocidal active substance or a biocidal product different from the details of approval of changes.
3. Any person who obtains acceptance for substance equivalence by fraud or other improper means, or who manufactures or imports a biocidal active substance different from the details of acceptance for substance equivalence
4. Any person who continues to manufacture or import a biocidal active substance without re-obtaining acceptance for substance/product equivalence.
Fine not exceeding 10 million won
1. Any person who fails to approval/notification of changes of the biocidal active substance(biocidal product)
